The Surface Transportation Board is officially keeping its civil penalty amounts for 2026 the same as they were in 2025. This means no inflation adjustment will apply this year.

Why it matters: This is mostly an administrative correction. The penalty amounts for railroads, pipelines, freight forwarders, and other regulated carriers will stay exactly where they were last year. If your company already set aside funds for 2026 compliance based on the board’s January proposal, nothing changes.

Who it affects

  • Rail carriers, freight forwarders, and pipeline operators regulated by the board

The Surface Transportation Board published this revised final rule in the Federal Register on May 1, 2026; verify the full text and penalty table before relying on it for compliance.
